Terms of Service

Welcome to Nettemp. These Terms of Service ("Terms") govern your access to and use of Nettemp's sensor monitoring platform, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.


1. Acceptance of Terms

By creating an account or using Nettemp, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.


2. Description of Service

Nettemp provides a cloud-based sensor monitoring platform that allows users to:

  • Collect and store sensor data from IoT devices
  • Visualize data through charts and dashboards
  • Configure alarms and receive notifications
  • Access historical data based on subscription tier
  • Manage devices and sensors through a web interface

3. Account Registration

3.1 Account Creation

  • You must provide accurate, complete information when creating an account
  • You must verify your email address to activate your account
  • You are responsible for maintaining the confidentiality of your password
  • You must notify us immediately of any unauthorized access to your account

3.2 Eligibility

  • You must be at least 13 years old to use the Service
  • If you are under 18, you must have parental consent
  • You represent that you have the authority to enter into these Terms

3.3 Account Termination

  • You may terminate your account at any time through account settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your data will be retained according to our data retention policy

4. Subscription Tiers

4.1 Free Tier

  • Data Retention: 30 days of detailed sensor data
  • Reading Limits: 300 readings per hour
  • Features: Basic monitoring, alarms, notifications
  • Support: Community support only
  • Service Level: Best-effort, no uptime guarantee
  • Availability: May be modified or discontinued at any time with 30 days notice

4.2 Premium Tier (Paid)

  • Data Retention: 90 days (30 days detailed + 60 days thinned)
  • Reading Limits: Higher hourly limits as specified
  • Features: All Free features plus extended retention
  • Support: Email support (48-hour response time)
  • Service Level: 99.5% monthly uptime target
  • Billing: Monthly or annual subscription

4.3 Pro Tier (Paid)

  • Data Retention: 365 days (30 days detailed + progressive thinning)
  • Reading Limits: Highest available limits
  • Features: All Premium features plus maximum retention
  • Support: Priority email support (24-hour response time)
  • Service Level: 99.9% monthly uptime target
  • Billing: Monthly or annual subscription
  • Advanced Features: Custom alerting, API access, multiple users (if applicable)

5. Payment Terms (Paid Tiers Only)

5.1 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Prices are stated in USD (or your local currency)
  • Payment is processed through our third-party payment providers
  • You authorize us to charge your payment method for all fees

5.2 Refunds

  • Monthly subscriptions: No refunds for partial months
  • Annual subscriptions: Pro-rated refund available within 30 days of purchase
  • No refunds after 30 days or for service usage
  • Refund requests: Contact us via Discord or dashboard support form

5.3 Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • Upon cancellation, your account reverts to Free tier with Free tier limitations
  • No refunds for unused portions of the billing period

5.4 Price Changes

  • We may change subscription prices with 30 days notice
  • Price changes apply at your next renewal date
  • Continued use after price change constitutes acceptance

5.5 Overages

  • Exceeding hourly reading limits may result in throttling or temporary suspension
  • Excessive usage may require upgrade to higher tier

6. Acceptable Use Policy

6.1 Prohibited Activities

You may NOT:

  • Violate any laws or regulations
  • Upload malicious code, viruses, or malware
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service for illegal surveillance or privacy violations
  • Scrape, crawl, or harvest data from the Service
  • Resell or redistribute the Service without authorization
  • Create multiple accounts to circumvent limits
  • Share API keys or account credentials
  • Send spam or unsolicited notifications
  • Use the Service to harm, harass, or threaten others

6.2 Data Usage Limits

  • Free tier: Maximum 300 readings per hour per user
  • Premium/Pro tiers: Limits as specified in your subscription
  • Burst limits may apply to prevent abuse
  • Systematic limit violations may result in account suspension

6.3 Monitoring Usage

  • We reserve the right to monitor usage patterns to ensure fair use
  • Abnormal usage patterns may be investigated
  • We may contact you regarding unusual activity

7. Data Ownership and License

7.1 Your Data

  • You retain all ownership rights to your sensor data
  • You grant us a license to store, process, and display your data as needed to provide the Service
  • We do not claim ownership of your data
  • You are responsible for the accuracy and legality of data you submit

7.2 Our Intellectual Property

  • Nettemp's software, design, logos, and content are protected by copyright and trademark
  • You may not copy, modify, or reverse-engineer our Service
  • You may not use our trademarks without permission

7.3 Data Backup

  • We perform regular backups, but you are responsible for maintaining your own backups
  • We are not liable for data loss due to your actions or third-party failures

8. Service Level and Availability

8.1 Free Tier

  • Service provided "as-is" with no uptime guarantees
  • May experience downtime for maintenance or upgrades
  • No compensation for service interruptions
  • Service may be modified or discontinued with 30 days notice

8.2 Paid Tiers (Premium/Pro)

  • Premium: 99.5% monthly uptime target
  • Pro: 99.9% monthly uptime target
  • Uptime measured excluding scheduled maintenance
  • Scheduled maintenance: Maximum 4 hours per month with 48-hour notice
  • Emergency maintenance: May occur without notice

8.3 Service Interruptions

  • We will make reasonable efforts to maintain service availability
  • We are not liable for downtime caused by:
    • Third-party service providers (Cloudflare, hosting providers)
    • Internet connectivity issues
    • Force majeure events
    • Your own network or equipment issues
    • Scheduled maintenance

8.4 Service Credits (Pro Tier Only)

  • If uptime falls below 99.0% in a month, you may request service credit
  • Credit equals 10% of monthly fee for each 1% below 99.0%
  • Maximum credit: 50% of monthly fee
  • Must request credit within 7 days of incident
  • Credits applied to future billing periods only

9. API Usage

9.1 API Access

  • API access provided via API tokens generated in your account
  • You are responsible for securing your API tokens
  • Tokens must not be shared or exposed publicly
  • Revoke compromised tokens immediately

9.2 API Limits

  • Rate limits apply based on your subscription tier
  • Excessive API usage may result in throttling
  • Bulk data upload: Maximum 100 unique sensors per request

9.3 API Changes

  • We may modify the API with reasonable notice
  • Breaking changes will be versioned
  • Legacy API versions supported for minimum 6 months

10. Privacy and Data Protection

10.1 Privacy Policy

  • Our Privacy Policy describes how we collect and use your data
  • By using the Service, you consent to our Privacy Policy
  • We comply with GDPR and applicable privacy laws

10.2 Data Security

  • We implement industry-standard security measures
  • Data transmitted via HTTPS/TLS encryption
  • Passwords hashed with PBKDF2 (100,000 iterations)
  • API tokens hashed with SHA-256

10.3 Data Retention

  • Active accounts: Data retained per subscription tier
  • Inactive accounts (no login for 365 days): Data may be deleted with 30 days notice
  • Deleted accounts: Data deleted within 30 days

10.4 Data Portability

  • You may export your data at any time
  • Data provided in JSON format via API or dashboard
  • No fee for data export

11. Third-Party Services

11.1 Integration Services

Nettemp integrates with third-party services for notifications:

  • Email providers (SendGrid, Mailgun, Resend)
  • SMS providers (SMSAPI)
  • Push notifications (Pushover)
  • Messaging platforms (Discord, Telegram, Ntfy)
  • Webhooks (user-defined endpoints)

11.2 Third-Party Terms

  • Third-party services have their own terms and privacy policies
  • We are not responsible for third-party service availability or actions
  • You are responsible for complying with third-party terms
  • Our Service may contain links to third-party websites
  • We are not responsible for external content or practices

12. Disclaimers and Limitations of Liability

12.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of uninterrupted or error-free operation
  • Warranties of data accuracy or reliability
  • Warranties that the Service meets your requirements

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability is limited to the amount you paid in the 12 months before the claim
  • Free tier users: Our liability is limited to $100 USD
  • We are not liable for data loss, business interruption, or lost profits

12.3 Use Cases

  • Nettemp is not certified for use in life-critical or safety-critical systems
  • Do not use for medical devices, industrial safety, or mission-critical applications
  • Use appropriate redundancy and safety measures for critical monitoring

12.4 No Warranty on Alarms

  • Alarm notifications are best-effort and not guaranteed
  • We are not liable for missed or delayed notifications
  • Critical systems should use redundant alerting methods

13. Indemnification

You agree to indemnify and hold harmless Nettemp, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of third-party rights
  • Your use or misuse of the Service
  • Content or data you submit to the Service

14. Modifications to Terms

14.1 Updates

  • We may modify these Terms at any time
  • Material changes will be notified via email or in-app notification
  • Notification provided at least 30 days before changes take effect
  • Continued use after changes constitutes acceptance

14.2 Objection to Changes

  • If you object to changes, you must stop using the Service
  • For paid subscriptions, you may cancel and receive pro-rated refund

15. Termination

15.1 By You

  • You may terminate your account at any time via account settings
  • Cancellation of paid subscription takes effect at end of billing period

15.2 By Us

We may suspend or terminate your account immediately for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees (for paid tiers)
  • Abuse of the Service or excessive resource usage
  • Security threats or compromised accounts

15.3 Effect of Termination

  • Access to the Service is immediately revoked
  • Data will be retained for 30 days for retrieval
  • After 30 days, all data may be permanently deleted
  • Paid subscriptions: No refund for unused portion

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

16.2 Dispute Resolution

  • Disputes should first be addressed via email to legal@nettemp.pl
  • We will attempt good-faith resolution within 30 days
  • If unresolved, disputes will be resolved in the courts of Poland

16.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.


17. General Provisions

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Nettemp.

17.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

17.3 Waiver

Failure to enforce any provision does not waive our right to enforce it later.

17.4 Assignment

You may not assign these Terms. We may assign these Terms to affiliates or in connection with a merger or sale.

17.5 Force Majeure

We are not liable for failures due to circumstances beyond our control (natural disasters, wars, strikes, internet failures, etc.).

  • User notices sent to your registered email address
  • Notices effective when sent
